Terms & Conditions of Rental

These terms form the agreement between you (the "Renter") and [COMPANY LEGAL NAME], a company registered in Kenya (registration no. [NUMBER], KRA PIN [PIN]), trading as RYDEX ("we", "us"). By creating an account or making a booking you accept these terms.

1. Who can rent

• You must be at least 21 years old and hold a valid driving licence for the vehicle class, held for at least [2] years.
• You must verify your identity by uploading your National ID or passport and driving licence, and present the originals at pickup.
• Only the verified Renter (and drivers we approve in writing) may drive the vehicle.
• We may refuse a rental if documents are invalid, expired or cannot be verified.

2. Bookings and payment

• Prices are in Kenya Shillings (KES) and include VAT where applicable [confirm VAT registration]. A service fee of KES 300 applies per booking.
• You may pay in full or pay a deposit (currently 30% of the total) by M-Pesa when booking. Any balance must be paid before or at pickup.
• A booking is reserved for 15 minutes while payment is completed. Unpaid bookings are cancelled automatically.
• A booking is confirmed once payment is received. You will receive an SMS confirmation.

3. Cancellations and refunds

• Cancellations 48 hours or more before the pickup time: full refund of amounts paid.
• Cancellations less than 48 hours before the pickup time: a cancellation fee of 50% applies and the rest of what you paid is refunded. Your dashboard shows the exact fee and refund before you confirm.
• Bookings cannot be cancelled online once the pickup time has passed. Contact us if your plans change on the day.
• No-shows: if the vehicle is not collected (or delivery is not accepted) within 24 hours of the pickup time, the booking is marked as a no-show and amounts paid are not refunded.
• Refunds are made to the original M-Pesa number within [7] working days.
• If we cancel your booking, you receive a full refund.

4. Security deposit

Some vehicles require a refundable security deposit, shown on the booking page. It is collected at pickup and returned within [7] days after the vehicle is returned, less any amounts owed for damage, missing fuel, cleaning, traffic fines or late return. We will explain any deduction in writing.

5. Insurance and your liability

• Vehicles are covered by [comprehensive] insurance with [INSURER]. You are liable for the insurance excess of KES [AMOUNT] per incident.
• Insurance does not cover damage caused by driving under the influence of alcohol or drugs, unauthorised drivers, off-road use, racing, or breach of these terms. In those cases you are liable for the full cost.
• You are responsible for traffic offences, fines, parking charges and tolls during the rental.

6. Using the vehicle

• Do not sub-let the vehicle, use it for hire or reward, or take it outside Kenya without our written consent.
• No smoking in the vehicle. A cleaning fee of KES [AMOUNT] may apply.
• Fuel: return the vehicle with the same fuel level as at pickup, or pay [refuelling charge].
• Mileage: [unlimited / X km per day, then KES Y per km].

7. Pickup, return and late return

• Pickup and return take place at the agreed location and time. We inspect the vehicle with you at both.
• Late returns are charged at [KES X per hour, up to one full day's rate]. Tell us as early as possible if you will be late.

8. Breakdowns and accidents

Call us immediately on [24/7 PHONE NUMBER]. For accidents, report to the nearest police station and obtain a police abstract. Do not authorise repairs without our consent.

9. Our liability

We are not liable for indirect or consequential losses, or for personal belongings left in the vehicle, except where the law does not allow us to exclude liability. [Advocate to review against the Consumer Protection Act, 2012.]

10. Personal data

We process your personal data as described in our Privacy Policy.

11. Governing law and disputes

These terms are governed by the laws of Kenya. Disputes will first be resolved by negotiation and, failing that, by the courts of Kenya [or arbitration in Nairobi].
